Your California Privacy Rights

Escala Financial values the trust each of our customer’s places in us to help realize their financial goals. Loan applications and the loan approval process requires the sharing of sensitive personal financial data to be gathered and disseminated to other third parties in an effort to close on your desired loan. Such third parties include but are not limited to: escrow companies, title companies, direct lenders, credit reporting companies.

In the loan approval process, we are required to collect personal financial data that support the nature and source of your earnings, credit profile, monthly obligations, tax returns, assets, work history, household members and dependents. By applying for a loan through us, you agree that we may share this information with the 3rd parties that are required to view this information.

Escala Financial shall use your personal information solely with the purpose of attaining the loan which you have applied for. Escala Financial does not share or sell your information to any entity unrelated to the loan approval and closing process. Escala Financial strictly forbids its employees and contractors from disseminating your information to any party not required to view the information for the purpose of attaining your loan. Escala Financial requires all employees and contractors to submit all personal financial data to Escala Financial for safe keeping for the required time our overseeing government entities require us to store your files. After this time, Escala Financial shall destroy any record of your personal information.

Subject to certain limits under California Civil Code § 1798.83, California residents may ask us to provide them with (i) a list of certain categories of personal information that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, and (ii) the identity of those third parties. We maintain administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

This Privacy Notice may be updated periodically and without prior notice to you to reflect changes in our personal information practices. We will post a prominent notice on our Sites to notify you of any significant changes to our Privacy Notice and indicate at the top of the notice when it was most recently updated.
